Child Car Seat Rules in Newark, NJ
What Parents Must Know
Under New Jersey child passenger safety law (N.J.S.A. 39:3-76.2a), every child riding in a passenger vehicle in Newark and throughout the state — including taxis and for-hire cars — must be secured in a restraint system that matches their age, weight, and height. New Jersey’s tiers are notably stricter than many neighboring states, and officers can stop and cite a driver for a restraint violation alone.
Rear-Facing Seats
Under age 2 and under 30 pounds
Children must ride in a federally approved rear-facing seat with a five-point harness until they reach at least age 2 and 30 pounds, or longer if they haven’t yet reached the seat manufacturer’s own height or weight limit.
Never install a rear-facing seat in the front passenger seat unless the airbag has been deactivated.
Forward-Facing Seats
Typically under age 4 and under 40 pounds
Once a child outgrows the rear-facing limits, move to a forward-facing seat with a five-point harness until they reach at least age 4 and 40 pounds, or the seat’s own manufacturer limit — whichever comes later.
Recommended only after outgrowing rear-facing limits — not by age alone.
Booster Seats
Under age 8 and shorter than 57 inches
Required once a child outgrows their forward-facing harness seat, until they turn 8 or reach 57 inches (4’9″) in height.
Always used with both the lap and shoulder belt together — never a lap belt alone.
Seat Belts & Placement
Children age 8 and up, or 57 inches and taller
May use a properly fitted vehicle seat belt without a booster.
It's recommended that all children under 13 remain in the back seat.
A violation of N.J.S.A. 39:3-76.2a carries a fine of $50 to $75 for a first offense (rising for repeat offenses), along with possible points against the driver’s license. Parents traveling to or from Newark Liberty International Airport are responsible for ensuring an appropriate car seat is secured before departure. For a closer look at how these rules apply statewide, see this breakdown of child seat rules in New Jersey.
