Child Car Seat Rules in Illinois
What Parents Must Know
Under the Illinois Child Passenger Protection Act (625 ILCS 25/), child passenger safety is required in every passenger vehicle statewide, including for-hire vehicles. All children under age 8 must be secured in a restraint system appropriate to their age, weight, and height — a stricter standard than many other states apply.
Rear-Facing Seats
Under age 2
Children must ride rear-facing until age 2, unless they already weigh 40 or more pounds or are 40 or more inches tall. Never install a rear-facing seat in front of an active airbag.
Never install rear-facing seats in the front passenger seat.
Forward-Facing Seats
Typically ages 2–4, once rear-facing limits are outgrown
Move to a forward-facing seat with a 5-point harness once the child exceeds the rear-facing seat’s height or weight limit. Harness straps should sit snug at armpit level.
Recommended only after outgrowing rear-facing limits—not by age alone.
Booster Seats
Ages 4 through 7
Required once a child outgrows their forward-facing harness seat, until they turn 8 or the vehicle’s adult seat belt fits correctly — typically around 4’9″ tall. A booster must always be used with both a lap belt and a shoulder belt; a lap-only belt does not meet the requirement.
Seat Belts & Placement
Age 8 and up, or once the adult belt fits correctly
A standard seat belt may be used once a child reaches age 8 or the belt fits properly across the shoulder and lap.
The Illinois Child Passenger Protection Act carries fines of $75 for a first violation and $200 for subsequent violations. Parents traveling to or from O’Hare or Midway are responsible for ensuring an appropriate car seat is secured before departure — either by requesting one through their chosen car service or bringing their own. For official guidance, see the Illinois Child Safety Seat Guidelines.
