Child Car Seat Rules in New York, NY

What Parents Must Know

Under New York Vehicle & Traffic Law § 1229-c, child passenger safety is strictly enforced across New York City and throughout the state. This is a primary enforcement law, meaning a driver can be pulled over for a restraint violation alone—no other reason is required. All children riding in passenger vehicles, including taxis and for-hire cars, must be secured in a restraint system appropriate to their age, weight, and height until they turn 8 years old.

Rear-Facing Seats

Under age 2 (mandatory since November 1, 2019)

Children must ride rear-facing until at least age 2, or longer if they haven’t yet reached the seat manufacturer’s maximum height or weight limit.

Never install rear-facing seats in the front passenger seat.

Forward-Facing Seats

Typically ages 2–4, once rear-facing limits are outgrown

Use a 5-point harness seat once the child exceeds the rear-facing seat’s manufacturer limits.

Recommended only after outgrowing rear-facing limits—not by age alone.

Booster Seats

Ages 4 through 7, or until 4'9" tall

Required once a child outgrows their forward-facing harness seat, until they turn 8 or reach 4 feet 9 inches in height.

Always used with both the lap and shoulder belt together—never a lap belt alone.

Seat Belts & Placement

Children age 8 and up (or 4'9" and taller)

May use a properly fitted vehicle seat belt without a booster.

It's recommended that all children under 13 remain in the back seat.

Because VTL § 1229-c is a primary enforcement law, drivers can be stopped and cited directly for non-compliance, with fines ranging from $25 to $100 per violation (up to roughly $138–$193 with surcharges in New York City) plus 3 points on the driver’s license. Parents traveling to or from JFK, LaGuardia, or Newark are responsible for ensuring an appropriate car seat is secured before departure.
