Child Car Seat Rules in Texas

What Parents Must Know

Under Texas Transportation Code § 545.412, it is an offense to transport a child younger than 8 who is not secured in an appropriate child passenger safety seat system, unless the child is taller than 4’9″. This is a primary enforcement law that applies to passenger cars, light trucks, SUVs, and passenger vans seating 15 or fewer, including for-hire vehicles.

Rear-Facing Seats

Birth to age 2 or beyond, as the seat allows

Texas law doesn’t set a specific rear-facing age, but TxDOT and the American Academy of Pediatrics recommend keeping children rear-facing until at least age 2, or until they reach the seat’s maximum height or weight limit — commonly 40–50 lbs on modern convertible seats. Never install a rear-facing seat in front of an active airbag.

Never install rear-facing seats in the front passenger seat.

Forward-Facing Seats

Typically starting around age 2, once rear-facing limits are outgrown

Move to a forward-facing seat with a 5-point harness once the child exceeds the rear-facing seat’s height or weight limit. Texas’s statute doesn’t separate this stage by name — it simply requires an “appropriate” seat system for the child’s size until age 8 or 4’9″.

Recommended only after outgrowing rear-facing limits—not by age alone.

Booster Seats

Typically ages 4–7, once the harness seat is outgrown

Once a child outgrows their forward-facing harness seat, a belt-positioning booster keeps them secured until they turn 8 or reach 4’9″ tall, whichever comes first. A good fit means the lap belt sits low across the thighs and the shoulder belt crosses the chest, not the neck.

Seat Belts & Placement

Age 8 and up, or once 4'9" tall

A standard seat belt may be used once a child turns 8 or reaches 4 feet 9 inches, whichever happens first. Safety experts still recommend a booster below that height even past age 8, and recommend children under 13 ride in the back seat.

Texas’s child passenger safety law carries fines ranging from $25 to $250 per violation, plus court costs, and is enforced as a primary offense — meaning an officer can stop a vehicle for this alone. Parents traveling to or from IAH or Hobby are responsible for ensuring an appropriate car seat is secured before departure — either by requesting one through their chosen car service or bringing their own. For official guidance, see the Texas DSHS Child Passenger Safety Law page.
