Child Car Seat Rules in Florida

What Parents Must Know

Under Florida Statute § 316.613, children age 5 and under must ride in a crash-tested, federally approved child restraint device. Florida’s rule is notably lighter than many states: it sets no rear-facing age, no 4’9″ height rule, and the restraint requirement ends at age 6 — though pediatricians and safety experts recommend keeping children in each stage well beyond the legal minimum.

Rear-Facing Seats

Birth to about 1 year

Florida law requires children ages 0 through 3 to ride in a separate car seat or a vehicle manufacturer’s integrated child seat — it doesn’t set a specific rear-facing age. Manufacturers and safety experts recommend keeping infants rear-facing at least until 1 year and 20 lbs, and ideally as long as the seat’s height and weight limits allow.

Never install rear-facing seats in the front passenger seat.

Forward-Facing Seats

Typically ages 1 through 3

Once a child outgrows the rear-facing limits of their seat, move to a forward-facing seat with a 5-point harness. This still falls under Florida’s “ages 0 through 3” car seat requirement — the law doesn’t separate rear- and forward-facing as distinct legal stages, but the seat itself does.

Recommended only after outgrowing rear-facing limits—not by age alone.

Booster Seats

Ages 4 and 5

Children ages 4 and 5 may ride in a separate carrier, an integrated child seat, or a booster seat. A 2026 bill (House Bill 233) would have extended the booster requirement through age 8 or 4’9″, but it died in committee in March 2026, so Florida’s legal minimum still stops at age 5.

Seat Belts & Placement

Age 6 and older

No specific restraint device is legally mandated from age 6 onward, but the child must use a properly fitted seat belt — lap belt low across the hips, shoulder belt across the chest, never the neck or stomach.

That last card in your screenshot already reads correctly — it’s just the Forward-Facing one that needs swapping out.

Violating Florida’s child restraint law is a moving violation carrying a $60 base fine plus surcharges and 3 points on the driver’s license. Parents traveling to or from MIA or FLL are responsible for ensuring an appropriate restraint is secured before departure — either by requesting one through their chosen car service or bringing their own. For official guidance, see the Florida Department of Highway Safety and Motor Vehicles’ Child Safety page.
